SB 1897 Failed – What Now

Well, if you did not already know SB 1897 was not heard in the House.

I know one of the things a lot of parents have had a problem understanding with this process is how the Government made a retroactive law. This just didn’t seem right to us.

Turns out it did not seem right to the people that authored the Texas Bill of Rights either.

If you would like to see it, the latest letter I sent is copied below and you will see what I mean about the Bill of Rights.

Phoenix Charter School in Greenville Texas is being forced to close based on a Retroactive Law passed in 2013. Two of the three reasons for the closure are violations that pre-dated the effective date of 2013 SB 2.

The portions of SB 2 that were made retroactive are in direct conflict with the Texas Constitution, Article 1. Bill of Rights, Section 16.

Section 16 is speaking directly to the Legislative Branch and is worded strongly and clearly. There is no wording for buts, ifs, or ands.

No Retroactive Law Shall Be Made.

The parents at Phoenix Charter School have sent nearly 2000 letters, more than ten thousand emails, made hundreds of phone calls, and signed petitions asking for help to stop the closure of our school.

So far there has been no sign of help coming. We are told that the decisions made by the TEA cannot be appealed. The latest answer we have been getting to our phone calls from the Representative’s offices is that there is not enough time left in the legislative session to help us.

I believe that SB 2 was passed with the intent to make our school system better and would not have been intentionally passed in conflict with the Bill of Rights. But, the way that portions of SB2 are worded and being implemented to cause the closure of schools based on existing discrepancies prior to the passage of SB 2 is wrong.

We are not asking that SB 2 be stricken out in its entirety but it should have never included retroactive provisions. These retroactive provisions should be removed immediately.


We request that the Bill of Rights section 16 and 29 be honored and that all adverse actions being taken against Phoenix Charter School, to include the
closure, be stopped immediately.

This is not a situation that requires a Judge or Lawyer to interpret what the law says. The Bill of Rights is clear in its wording. The legislative branch does not have the authority to make retroactive laws.

As we all know SB 2 was passed with provisions that made it retroactive. Below is what the Texas Constitution says about this subject. I changed the text to bold and underlined some of the key words that apply directly to this situation.

Please take action on this immediately and stop the closure of our children’s school. We have asked for help repeatedly and we will continue to do so.
This is not a situation that should be ignored, it is one that should be remedied immediately.

Saturday Meeting and New Letter

We had a good turn out yesterday. (Saturday)

There were a lot of emails sent to the representatives and a whole stack of letters mailed to our Representative, Dan Flynn.

Several of the parents were also getting together with friends at their houses later in the day and passing out stuff at church. Looks like the Representatives should be a getting a flood of emails and letters from this weekend.

Anyone who can, please continue to make a few phone calls this week and see what we can make happen.

The House has until May 23rd to have Senate Bills out of committee so we should be able to see how the wording of SB 1897 ends up by next weekend.

No meeting for this Thursday, the meeting time has been moved to Saturdays at 10:00 because more people were able to make it this way.

Wanted to say thanks to Melissa, Carmen, and Ms. Otis for helping people write and send emails on Saturday. Also to Ms. Navarro for translating the last letter to Spanish.

Please take this opportunity while SB 1897 is in the House Education Committee to make some improvements to SB 1897.

I would like to ask that para 12.1141 (d) (3) of the education code concerning the expiration of a charter be amended to state.

(3)the charter holder has been assigned any combination of four or more of the ratings described by Subdivision (1) or (2) for any three of the five preceding school years; or
With the current wording a school could have a total of four Unsatisfactory Academic and Financial ratings as long as they occurred in 2 years. They would not meet the requirement to expire the charter.

This would also allow for schools to remain open that have one off failures but do not demonstrate a systemic issue such as would be shown by the requirements of 12.1141 (d) (1) & (2).

Phoenix Charter School is in the position where the TEA is forcing the charter to expire based on para 12.1141 (d) (3).

One of the failures was that the annual financial report was turned in late to the State system during an administration change. The report was filed on time to the federal system and there was no actual financial misconduct, just the late report.

While I agree that this type of administrative error should be corrected and the superintendant deserves reprimand for it, I do not agree that the students and families at Phoenix Charter School should be punished so harshly for it.

This is a very poor reason to take away this school from our children.

We need to throw our voice out there in support of SB 1897 and ask for a change to the current wording.

Andrea mentioned to me yesterday that one of her friends called a representative’s office a couple of days ago and the person answering the phone knew she was calling about PCS before she even told her. We are making enough noise that they know who we are and you know the saying about the squeaky wheel!

This bill has been substituted, meaning that it was changed during review by the Senate Education Committee. While this did remove the wording that would have allowed for reconstitution in lieu of closure, it has still left us another opportunity.

In the rewrite, provisions were included to allow schools to contest low academic or financial ratings that resulted from inaccurate data or calculation errors.

Of course everything in this process for us has had a catch so far. So here is the catch.

The wording of the Bill does not currently state that you can dispute errors from previous years. So, we are just going to ask for the House to add this to the bill. SB 1897 was completely changed during the Senate Committee review.

All we are asking for is one small change during the House Committee review.

The change we are asking for would not alter the current intent of the Bill so hopefully we will not meet with much resistance in such a small change.

Current Action Plan

Here is what we need to do.

Step 1.
Write an email to the House Education Committee, Senator Hall, Representative Flynn, Senator Taylor, and Senator Campbell. (Contact Information Below)

· Tell them that one of the reasons our school is being closed is due to an Academically Unsatisfactory Rating from 2011.

· This rating was a direct result of Inaccurate Data from the 2009-2010 school year.

· The school tried to present the new data to the TEA but they declined to hear an appeal.

· When SB2 was passed in 2013 it contained language that allowed for our school to be closed based on TEA ratings from previous years.

  • We should have the Right to dispute ratings based on inaccurate data from the same years that SB2 allows for consideration in closing or expiring a school.

· We support SB 1897 because we believe that good schools should not be closed because of inaccurate data. (If you would like also mention that one of the other 3 cited failures was an annual financial report being filed late.)

· Ask them to adjust the wording in SB 1897 to allow for prior school year ratings to be disputed by the school. Especially if these ratings are resulting in any adverse action against the school.

· Ask them to make provisions that any school currently being closed, or facing expiration due to inaccurate data, be allowed to challenge these ratings prior to closure or expiration.

· Include any personal information that you would like about what the school means to us and our children.

Step 2.
After completing the email print 15 copies of this to be used as a letter. Mail them to each address below.

Step 3.
Call all 15 of the offices listed below and express the same concerns as above. (This doesn’t have to be during normal business hours, just do it at whatever time of the day or night that you can and leave a message after the beep.)

Step 4.
Not exactly a step but, We Have To Do This Now. The last day for the House Committees to report out Senate Bills is May 23rd. We need to get our voice out quickly enough that they can hear us and have time to respond and make the changes we need.

The information below is from the first letter that I wrote but I was not sure if everyone has seen this already.

2011 Academically Unacceptable Rating

In the report that I got from the TEA on this one, they change the text to orange for the areas that did not meet standards.

You can see from the snap shots of the report below that there were 2 issues.

The first one was for mathematics. The test scores shown for Econ Disadv were 4% below the requirement. The total mathematics score for all children did meet standards though.

The second one concerned 8 students who had left the school. The school did not have an immediate paper trail showing where these students had transferred to so they are counted as a drop out. The school was able to track down 5 of these students leaving only 3 unaccounted for. When the school requested that the TEA consider the new information they declined and the rating was left the same.

Since I have no idea how this is actually rated I cannot say myself if this would have changed the rating. After receiving a reply from Ms. Turnipseed though she indicates that she believes the score would have changed based on the new information.

“Let me address the 1st unacceptable rating, 8 students were unaccounted for and 5 were found.”

SB 1897 May Provide Some Help

SB 1897 passed the Senate with a Majority Vote yesterday and has moved on to the House.

I believe that it will first go to the House Committee for Education. After it has passed through the committee it will move on to the House for a vote. For it to be effective immediately it will have to pass by a two-thirds majority in the House as well.

Below is a note from the Fiscal report on this Bill that pertains to the section I am hoping can help us.

“The bill would direct the Commissioner to assign a district a corrected rating if the district’s rating is challenged and the challenge demonstrates that a data, calculation error, or inaccuracy caused the district to have a lower academic or financial accountability rating.”

I think this should help with the 2011 Academically Unacceptable Rating if I understand this correctly.

 

As for HB 3281, it looks like that Bill is no more. It was still left pending in committee as of today. The deadline to have the house bills out of committee was yesterday.

I know everyone worked hard getting our voice out there but HB 3281 was just not meant to be. It is not over yet though.

We have SB 1897 that could still help us out.

I did get a response back from the Texas Charter Association. Their Executive Director said that he would try and find something that would help the Phoenix Parents and get back with me. I will keep you posted on that as soon as I hear something.

Important – We Have to Take Action This Weekend

Here is the situation.

The deadline for bills to be out of the house committee is this Monday. That means for HB 3281 we have this weekend to make phone calls and send emails to the House Education Committee. If it is not voted on by this committee on Monday it looks like HB 3281 will be dead in the water.

This weekend we need to call every office on the list below and leave a message. Then we need to all send each of them at least one email.

Tell the members of the education committee listed below that;
• We Support HB 3281
• We request that HB 3281 be voted on by the education committee immediately.
• That we support Phoenix Charter School and are desperate to find a solution to keep our school open.
• If HB 3281 passes with a Majority vote it will save our school.

To My Fellow Phoenix School Parents and the Students

As you know the TEA is closing our children’s school at the end of this year. I would like to pass on a little of the information that I have learned on this subject.

I would also like to detail a plan for what we can do to help get this decision over-turned a little later in this letter. So, please read it all the way through and help us take action to stop this.

SB2 1-Sep-2013 – The Source of our Current Issue

SB2 was passed and became effective 1-Sep-2013. This bill was sponsored by the current Chair Person of the House Committee on Public Education. It was passed by this committee by a vote of 7 Ayes, 0 Nays, and 4 absent on 13-May-2013. It then passed the House on 17-May-2013 and was subsequently signed by the Governor and became law 1-Sep-2013.

This new law allowed for the closure of charter schools based on past unsatisfactory ratings that would not have required school closure at the time they occurred. I believe this is why the ratings were not more strongly disputed by the school at the time that they happened.

If you look at it from the point of view of this law, if I change my son’s bedtime this week I should automatically ground him for staying up too late last week.

We will get to the actual cited failures in a moment but first I want to bring up our hope for changing this situation.

HB 3281 Sponsored by Rep. James Frank

HB 3281 would change some of the requirements introduced by SB2 that allow for schools to be closed over technicalities. It also introduces changes that would allow for disputed closures to be seen by a judge instead of the current wording that disallows for a charter school to have the right to appeal.

In section 7 of this bill it states that it would go into effect immediately if it receives a two-thirds majority vote. If this were to happen then our school would stay open and our children will still be attending Phoenix next year. The school that we have all chosen for them to go to.

HB 3281 was introduced 12-Mar-2015 and referred to the House Committee on Public Education 17-Mar-2015. Here is where it sits. The last update is “Left Pending In Committee.”

So what does this mean? It means that they are doing nothing. They are not even going to vote for, or against it.

I find this unacceptable. They are not even going to vote against it and tell us no. Instead they are just going to let it sit there and do nothing.
Personally, I am kind of tired of our government’s uncanny ability to do nothing.

So…What Can We Do About It?

One thing we can do is keep quiet and do nothing. That will send the clear message to the Senate and House Committees on Public Education that we think they are making the right decision for our children.

Since I do not happen to agree with them on this, I am speaking up.

There are currently 11 committee members of each committee for a total of 22.

So here is what we can do.

· Write letters to each of these 22 members and mail them to their offices. Then call all of their offices and ask that HB 3281 go to vote immediately. Send all of them repeated emails asking for something to be done about closing our school.

· Every time you email one of them copy all of the others. This way they know we are contacting all of the members on these committees.

· Be polite but insistent that they hear our concerns. We do need the help of these people and we are clearly in the underdog position.

· Tell them that HB 3281 must be a priority to vote and should not be sitting on the House Desk.

· Tell them that HB 3281 must have verbiage that makes it effective in June of 2015. If it waits until September of 2015 it will already be too late for
us.

· Explain to them that we made a choice to send our children to this school because we believe it is the best option for them. Even though each and every one of us has to take our child to school and pick them up every day. If we wanted the easy way we would just let the GISD bus shuttle our kids back and
forth to school for us.

· We can tell them that we do not agree with their decision to take our choice away and that this is the only Charter school in our entire county.

What Else Can We Do

In separate posts below you can find the email addresses of all 31 Texas Senators and 150 Representatives. I have emailed every single one of them a couple of times and my son has emailed them all once already.

There is also a post with all of the contact info for the Senate and House Education Committees.

I have been emailing in batches of 50. When I tried to do all of them at the same time the email did not go through and I got an error back saying too many recipients.

The first time I emailed all of them I had to do them one by one on the web submission forms. This is a much easier way.

As For The Unsatisfactory Conditions Cited By The TEA

I know this is something we have all wanted some clear information on.

SB2 changed the law to allow for the non-renewal of a charter if there have been 3 unsatisfactory ratings in the last 5 years. These ratings can be a combination of failures in any rated area. In our case there are 2 academic and 1 financial.

Even though the effort to revoke the schools charter was over-turned our current problem is stemming from the wording of the law concerning non-renewal.

We will start with the financial.

2012-2013 Financial Rating. (Based on the 2011-2012 School Year)

Below is a snap shot of the report that issued the Unsatisfactory financial rating.

As you can see the only failure was that a report was turned in late. Our school only meets the minimum requirement of the laws passed by SB2 to qualify for non-renewal.

So you could easily interpret this as the non-renewal of our charter is based on a report being turned in late. Not that the funds were mismanaged, or there was theft involved, or the money received from the state was being spent on items other than what it was intended.

Nope, our children’s school is being taken away over a piece of paper not being received in a timely manner.

Financial

I received this report from the TEA. In this case I did not really need any clarification sine you can see the areas marked as Pass or Fail in the left hand column.

But here is the response that I got from Ms. Turnipseed concerning the financial rating.

For the Financial unacceptable rating, The report was uploaded to the Federal Clearinghouse on time and it was not uploaded to the State until 4 months later because of the change in Leadership. The previous Superintendent did not upload it.”

“If a school answers NO to any of the first 5 or 6 questions. It is an automatic FAIL. When we reviewed the budget. It was off by $138.00.”

2011 Academically Unacceptable Rating

In the report that I got from the TEA on this one, they change the text to orange for the areas that did not meet standards.

You can see from the snap shots of the report below that there were 2 issues.

The first one was for mathematics. The test scores shown for Econ Disadv were 4% below the requirement. The total mathematics score for all children did meet standards though.

The second one concerned 8 students who had left the school. The school did not have an immediate paper trail showing where these students had transferred to so they are counted as a drop out. The school was able to track down 5 of these students leaving only 3 unaccounted for. When the school requested that the TEA consider the new information they declined and the rating was left the same.

Since I have no idea how this is actually rated I cannot say myself if this would have changed the rating. After receiving a reply from Ms. Turnipseed though she indicates that she believes the score would have changed based on the new information.

From Ms. Turnipseed’s response to my questions.

“Let me address the 1st unacceptable rating, 8 students were unaccounted for and 5 were found.”

“I believe that the number of students who were found would have changed our rating.”

2014 Improvement Required – Closing The Gap

For this one, the school just did not meet the standard. Not really much to say about it other than they have been working to improve this. From what I have been told of the test scores that are already back there has been significant improvement already.

Below is the response I got from Ms. Turnipseed concerning this and a snap shot of the report from the TEA.


“The Last “strike” was due to the the school not meeting the criteria for index 3. Closing the Achievement Gap to which over 33% of the schools in Texas failed to meet the criteria.”

I hope you find this helpful. Seems like our last chance of keeping the school open is to make our voices heard about passing HB 3281. If we want our school to be here for our children next year we have to speak up now.

Just yesterday my son told me that he still thinks they are not going to close his school. When they first announced the school closing there were several nights that he just couldn’t sleep he was so worried about it. From talking to other parents he was not the only child that felt this way. I hope he is
right.
